CONTRACT FOR TRANSPORT WITHIN THE REPUBLIC OF INDIA*

Definitions
Destination means a specific location that the passenger requests to go. There may be more than one destination in a journey.
Driver means the person with whom the negotiation takes place, or another person specified by the negotiator and agreed to by the passenger.
Final means there is to be no further negotiation of any element of the price once agreed.
Final destinationmeans the specific location where the journey will finish, this contract will end and the agreed price will be paid.
Journey commencement means when the vehicle is loaded and starts forward progress towards the destination.
Luggage means the articles on the passengers which are either visible during the negotiation process or described by the passenger to the driver.
Now means right now, not in 20 minutes, or after the driver finishes chai/talks to a friend/checks the cricket score.
Passenger means the people listed in this contract.
Reasonable person means someone who is not in the Indian passenger transport industry.
Vehicle includes but is not limited to cycle rickshaw, auto rickshaw, jeep, taxi, private car, boat, raft, livestock
OFFER & ACCEPTANCE
- This contract applies to the vehicle sighted by the passenger upon making the contract. No other vehicle shall be used for the purposes of this contract
- The price agreed to is precisely _____ Indian Rupees. This price is final on journey commencement. The price is not to be renegotiated after journey commencement. The agreed price is agreed once the passenger offers and the driver accepts. Acceptanceis given by the driver by expressly agreeing, or through any of the following terms: 'as you like,' 'no problem,' [head wobble], [smile], so long as the passenger repeats the offer for services 3 times. If the driver commences loading luggage into the vehicle after a price is offered it will be taken that the price is agreed.
- The price is all inclusive. All inclusive means but is not limited to taxes, fees, levies, bribes, religious offerings, tips, donations, tolls, entrance costs, petrol and mechanical requirements post journey commencement until arriving at final destination, driver personal requirements (including but not limited to food and toilet charges).
- The price includes any unsolicited offer by the driver to wait for the passenger to travel onwards once the final destination is reached. Waiting time is at the express prerogative of the driver and the passenger is not responsible for compensation of the driver's time.
- The price includes all luggage currently with the passengers. If shopping is included in the journey the price includes all purchases that a reasonable person would expect to fit inside or on top of the vehicle. Luggage wallah charge is never applicable.
- All luggage is to be secured firmly to or inside the vehicle prior to journey commencement.
- The contract requires the vehicle to carry no more than ____ passenger(s) plus ____ driver(s). Upon journey commencement no further people will be allowed to ride inside or outside the vehicle.
- The vehicle is not allowed to carry additional goods beyond the passenger and their luggage. This includes but is not limited to other people, other peoples' luggage, cookware, fruits and vegetables, household goods, major appliances, and livestock.
- The vehicle is to travel from point of journey commencement to destination. Only the passenger may authorise an amendment to the journey. Under no circumstances is the route to include unauthorised stops at the drivers' friend's hotel, restaurant, silk shop, travel agency, musical instrument factory, ashram, roadside stall. If there is ambiguity regarding the destination, for example there is more than one train station, it is the driver's responsibility to clarify this ambiguity prior to journey commencement.
- The vehicle is to be sighted and agreed to by the passenger prior to journey commencement.
- The driver is to be sighted and agreed to by the passenger prior to journey commencement.
- The seat to be occupied by the passenger is to be sighted and agreed to by the passenger prior to journey commencement.
- The vehicle, the driver, and the seat are not to be altered in any way once sighted by the passenger.
- Inability to reach the destination post journey commencement and sudden inability to speak any English, despite negotiating the fare in English, will result in the driver forfeiting the fare.
- Additional kilometers travelled due to getting lost or diverting to unwanted destinations (such as those referred to in clause 9) does not warrant a renegotiation of the fare. This contract indemnifies the passenger from any financial liability with respect to a longer journey taken due to the driver not knowing the destination.
- The destination will not be considered closed, burned down, rat infested, behind locked gates, too far away until this is verified first hand by the passenger.
- Blaring distorted music at decibels equivalent to an airplane jet through blown speakers during the journey will result in loss of 50% of the fare and a smack upside the head.
